Terms of Service
Effective Date: May 13, 2026
These Terms of Service ("Terms") govern your use of Disposable.photo, LLC. By using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. About the Service
disposable.photo is a shared event photography web application. Hosts create events and share QR codes with guests. Guests capture photos through an in-browser camera. Photos are stored privately until the host reveals the album.
2. Eligibility
- You must be at least 13 years old to create a host account.
- Guests under 13 may participate only under direct parental supervision.
- By using the Service you represent that you meet these requirements.
3. Host Accounts
- You are responsible for the security of your credentials and all activity under your account.
- You may not share accounts or create accounts on behalf of others without consent.
- We may suspend or terminate accounts that violate these Terms.
4. Events and Guest Access
- Hosts are responsible for the events they create and the guests they invite.
- Hosts control the reveal timing and album access.
- Guests do not require an account. Only a first name is collected from guests.
5. Acceptable Use
You agree not to use the Service to:
- Capture or share photos that are illegal, obscene, defamatory, harassing, or otherwise harmful.
- Capture or share images of any person without their consent.
- Capture, store, transmit, or distribute child sexual abuse material (CSAM) or any content that sexualizes, exploits, or endangers minors in any way whatsoever.
- Violate any applicable local, state, federal, or international laws or regulations.
- Attempt to reverse engineer, hack, disable, or circumvent the Service or its content moderation systems.
- Use the Service for surveillance, unauthorized data collection, or impersonation.
6. Content Moderation — Two-Tier System
Tier 1 — Google Cloud Vision SafeSearch
Every photo is automatically scanned before storage. Photos flagged as explicit, violent, or racy at a LIKELY or VERY_LIKELY level are immediately discarded and never stored. The guest's shot counter is restored. The event is logged by ID, timestamp, and device IP.
Tier 2 — Microsoft PhotoDNA CSAM Detection
Simultaneously, every photo is hashed and compared against the NCMEC database of known CSAM. This process is fully automated. No human views the image. Upon a hash match:
- The photo is immediately quarantined in a secure, restricted storage bucket inaccessible to any user.
- An automated safety alert is triggered to our safety team.
- A report is submitted to the NCMEC CyberTipline as required by 18 U.S.C. § 2258A.
- The associated account is permanently terminated.
- We cooperate fully with law enforcement.
- The quarantined image is deleted after mandatory reporting is complete.
Staff at disposable.photo do not view CSAM images at any point in this process.
User Reporting
A report button is available on every photo in a revealed album. Reported photos are immediately hidden and reviewed. Confirmed violations are permanently deleted. Suspected CSAM is processed under Tier 2 above regardless of how it is identified.
Zero Tolerance
Any user who captures, transmits, or attempts to share CSAM through the Service will be permanently banned, reported to NCMEC, and referred to law enforcement. This is not discretionary. There are no exceptions.
7. Photos and Content Ownership
You retain ownership of your photos. By using the Service you grant disposable.photo a limited, non-exclusive license to store, display within your event, and process your photos as necessary to provide the Service — including content moderation scanning, watermarking, and print fulfillment. We do not sell your photos to third parties.
8. Watermarks
All downloaded or shared photos include the disposable.photo watermark on all tiers. On the Branded tier the watermark is reduced in prominence alongside the host's own logo. The watermark is a non-negotiable condition of use.
9. Pricing and Payments
- The Service offers a free tier and paid per-event tiers as listed on our Pricing page.
- Paid tiers are charged per event at purchase.
- All sales are final. No refunds except as required by applicable law.
- Prices are subject to change with notice.
10. Album Expiration
Albums expire per your tier after the event close date. Expired photos are permanently deleted. It is your responsibility to download photos before expiration. We are not liable for photos lost due to expiration.
11. Print Fulfillment
Print fulfillment is provided through third-party retail partners. By using the print feature you agree to those partners' terms. disposable.photo is not responsible for print quality, delays, or errors caused by third-party fulfillment partners.
12. Social Media Sharing
Social sharing is available on paid tiers. You are subject to the terms of any social platform you share to. disposable.photo is not responsible for content after it is shared to third-party platforms.
13. Intellectual Property
The disposable.photo name, logo, design, and application are owned by Disposable Photo and protected by applicable intellectual property law. You may not use our branding without written permission.
14. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. AUTOMATED CONTENT MODERATION REDUCES BUT DOES NOT ELIMINATE ALL RISK. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STUDIO 8 TWENTY-TWO LLC, DBA DISPOSABLE.PHOTO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA OR PHOTOS, ARISING FROM YOUR USE OF THE SERVICE.
16. Indemnification
You agree to indemnify and hold harmless Disposable Photo from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, violation of any third-party rights, or any content you capture or share through the Service.
17. Governing Law
These Terms are governed by the laws of the State of Texas. Disputes shall be resolved in the courts of Fort Bend County, Texas.
18. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated by email or notice on the Service. Continued use after changes constitutes acceptance.
